Our I-485 applications were received by Texas Lock box on September 24th. I have not received the receipt number yet. We are leaving to India on Nov 20th for vacation, its quite stressful because we need that receipt before we travel.

Hi ,
I am going to tgransfer my H1 b with new employer .
My employer is going for normal processing and I asked him for premium processing as my project is going to end by Aug 2009 . Then My employer informed me that there are lot of RFEs for premium processing . Is it true ?
Please suggest whether I should go for premium or not ?

In my opinion I think we should get the news guys into this and get the information out there about the irresponsibility with which they have mismanaged the whole process. Such kind of problems usually grab headlines when it happens with US citizens.
I think we need to be heard. Imagine, insurance companies violating makes news, social security makes news, airport security regulations and mismanagement makes news _ WHY CANT THIS? THIS IS SO CRUEL. HOW MANY HOURS, MONEY, EFFORT HAS GONE DOWN THE DRAIN? CAN WE NOT GET SOME NEWS CHANNEL TO COVER THIS? SOMEONE TO SPEAK TO A JOURNALIST ABOUT HOW AWFUL IT HAS BEEN????
THIS HAS ALL THE ELEMENTS OF PAIN, AGONY, AND DECEIT. Please comment. Only when we do this, will we get the EB numbers to get increased. Only then , the lawmakers will get up and smell the coffee. LEGAL IMMIGRANTS AND WHAT DO WE GET AFTER OBEYING THE LAW? MISMANAGEMENT THROWN AT OUR FACE.

I have a situation here.
I am on H1B visa and just changed my job in September.
My H1B transfer (thru my new company) was approved and according to USCIS website, they have dispatched my 797-Notice of Action. But I am yet to receive those papers.
Now, I was on extension of H1B earlier (thru my old company), as my stamped visa expired.
Now, my spouse needs to visit India urgently. Can she travel to India with her old I-94 (the one that was stapled on the passport when she entered US the last time) and the other I-94 that she has with the visa extension papers ?? Of course, once we get the new Form 797, I shall also travel to India and we both will get our visa stamping done before we travel back to USA. Please suggest...

My wife is on H4 currently (came into USA on H4). We are planning to apply for her H1 in April. Once it is approved, we are planning to to CANADA for H1 stamping.Her current H4 visa expired in 2006. I-797 is valid till May 2007.
How easy is to get new H1 stamping (from H4) in CANADA?
What issues you face?
She has a US masters Degree?

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

1. Date is current(because of interfile) and received 2 year EAD
2. USCIS District Office IO cannot find whether the case is EB2 or EB3. Is it true or there any experiences?
3. Does any one know of any pattern of how long it will take to approve the case once its assigned to an Office?
Any input is greatly appreciated.

It is a one way street once that check is cashed. No refunds from USCIS. If the application gets returned from the mailroom for some mistake like missing signature, you will get your check submitted back.

I am working for company A on H1 which is valid until November 2010. I would like to work for Company B on EAD, since company B would not do H1
To be on the safer side, I would to like have another H1 from company C, so that if anything happens with I-485, I can join company C on the H1.
Is this possible? Do I have to travel out of country in order to work for company C on H1?

Thats not an issue looks like. When you go for FP, just ask them to see if your name is correct in the system with you A number. Thats more important thatn the spelling on notice.

The logic of making everyone current is that USCIS need to use up all the 140,000 visas by end of fiscal year.
I think that the slot does not get counted against the 140,000 until the GC is approved.
Therefore, USCIS may need to approve a lot of GC before October.
That would mean they need to process a bunch of applications within a 3 month period.
Is my logic flawed? Or might there be hope that some good number of us will get GC in 3 to 4 months?
